Terms & Conditions for My MedPark platform ("Terms & Conditions")

TPP Healthcare International Co. Ltd. ("MedPark," "We" or "Our") has created My MedPark platform and www.medparkhospital.com, including websites, websites for mobile devices or mobile platform (“Platform”) to be the channel of contact and communication between MedPark and its service users (“User”, “Users”, “Patient”, "You" or "Your"), including provision of services for Patient, such as, scheduling an appointment, accessing to user’s health data, updating a user's personal data, including additional purposes to be later determined by MedPark.

The Platform's Users have read and accept that the Users will be bound by the Terms & Conditions specified in the Platform. Users are requested to study the following Terms & Conditions thoroughly and carefully before using the Platform. If you carry out any action on the Platform, it shall be deemed that you accept and agree to comply with these Terms & Conditions. MedPark has the right to correct, change or cancel these Terms & Conditions and/or any other agreements on the Platform without prior notice to Users.

Definitions
- 1.1. "Services" means the services listed in Article 2 below provided by MedPark Hospital and/or any of its subsidiaries which User can access via the Platform.
- 1.2 "Account" means User’s account opened for accessing Services, which will be linked to the database system of MedPark Hospital and clinics operated by MedPark and/or its subsidiaries, including User’s health information.
- 1.3 "User" means a person using the Platform (registered or not) subjecting to these Terms and Conditions.
- 1.4 "Identification Code" means Login Name, Username, Password, Mobile PIN (Mobile Personal Identification Number), OTP (One Time Password), including other codes for identification of User accessing Services, either set by MedPark or User.
- 1.5. Unless the contrary appears from the context, words importing the singular number include the plural number, and vice versa.
Services
- 2.1 Scope of Services accessible by User through the Platform includes:
  - Searching for doctors;
  - Appointment scheduling for health consultation or medical services;
  - Emergency medical assistance services;
  - User’s health data;
  - Medical or related information inquiries;
  - News and announcements by MedPark; and
  - Any other future services as may be introduced by MedPark.
- 2.2 For certain types of Services, User will be required to register and log in (Log In) prior to his/her access to such Services and may be subject to additional terms and conditions.
- 2.3 Benefit offered by MedPark to each user can vary from one user to another, depending on service history of each user, promotional program of each product and/or marketing policy of MedPark.
User’s Registration
- 3.1 Registration is not required for basic use of the Platform. However, to enjoy the full benefits and functions of the platform, we recommend User to complete MedPark’s patient registration at MedPark Hospital by providing data as specified by MedPark. The Service User will be bound by and shall comply with these Terms & Conditions.
- 3.2 User will authenticate himself/herself by entering the OTP sent by MedPark within a specified time, and User will then set the PIN (Personal Identification Number)
- 3.3 User shall keep confidential and shall not disclose or reveal his/her Identification Code to others. If User becomes aware that his/her Identification Code is disclosed to another person, User must promptly notify MedPark.
- 3.4 User may change his/her PIN (Personal Identification Number) for accessing the Platform according to MedPark’s protocol.
- 3.5 User affirms that:
  - User represents that all the data provided to MedPark on the Platform are true and complete. Specifically, the User also represents that his/her mobile phone number or personal email is valid and operational at the time of providing the data.
  - User is the person interacting with the Platform him/herself.
- 3.6 User can update his/her personal data via the Platform or contact MedPark Patient Access service at Tel. 02-023-3333. User gives assurance that if there are changes to personal data, User shall always keep the information on the Platform up to date.
- 3.7 User acknowledges and agrees that any action made using the User’s Identification Code on the Platform or other portals specified by MedPark Hospital is made by and has legal binding on the User.
Using My MedPark platform
- 4.1 User acknowledges that certain medical or technical terms related to Services are in foreign language(s) which may be difficult to understand. Therefore, MedPark may provide Thai translation of such terms in simplified Thai words for ease of understanding. The translated words may not have the exact meanings as the original terms. If User has any concerns about his/her patient information or Services, please contact MedPark Hospital.
- 4.2 User agrees and acknowledges that MedPark does not warrant the accuracy and completeness of content on the Platform and does not warrant that the Platform is virus-free or free from other elements that may affect your mobile device.
- 4.3 Every time the Platform is used, it is deemed that User knows of these Terms & Conditions, including any amendments thereof which are fully in effect at the time, and agrees to comply with those Terms & Conditions and any amendments thereof in all respects.
- 4.4 If any error occurs while using the Platform or User has any concern regarding his/her data, User shall notify MedPark to confirm, check, and correct such errors.
Privacy Policy
- 5.1 MedPark's Privacy Policy regarding the confidentiality of User’s information is as follows:
  - User is deemed to have granted consent to MedPark and MedPark’s subcontractors and service providers to keep, collect, use, and disclose any information, including personal information, such as contact details, financial transactions, devices, or equipment using the Platform, pursuant to the Personal Data Protection Act of 2019 for the purpose of providing Services.
  - MedPark will keep, collect, use, and disclose User’s information with security consideration in accordance with applicable laws and MedPark’s policies.
- 5.2 Upon access to the Platform, User is deemed to have agreed to accept and comply with MedPark’s Privacy Policy which may be changed from time to time without prior notice.
Responsibilities of User for My MedPark platform
- 6.1 User must not upload or submit through the Platform data containing virus, malwares, Trojans or software program that interferes, intervenes, blocks, or destroys computer system into the computer network of MedPark.
- 6.2 User will not: (a) copy, decompile, reverse engineer or act in any way to change any part of the Platform; (b) intervene or block the operation of any software, system, device, equipment or network used in connection with Services or violate any rule, regulation or policy of Services; (c) bypass verification process and security check in respect of Services, network or related system; (d) access and/or use Services by any mean other than as set out in these Terms and Conditions; (e) use the Platform in the way that is in violation of the laws; (f) allow unauthorized persons to use PIN (Personal Identification Number) or any means in order for them to access and use Services.
- 6.3 User shall indemnify and hold harmless MedPark from any claim or damages arising out of or resulting from User’s violation of the laws or these Terms and Conditions or the use of the Platform in a way that may cause damages to others (including but not limited to lawyers, and litigation fees and expenses).
Amendment, Limitation, Suspension, Access Termination and Use of My MedPark platform
- 7.1 User agrees to use the Platform on “As Is and As Available” basis. MedPark reserves its right to update and/or improve the Platform at any time without prior notice in which some functions or Services may be changed, limited, suspended or terminated.
- 7.2 User accepts that MedPark has the right to deny the Service of the Platform, suspend or cancel access to the Platform, in part or in whole, at its sole discretion for any reason.
- 7.3 MedPark reserves its right to amend these Terms and Conditions at any time without prior notice. MedPark will notify User about such amendments through the Platform or other means as MedPark may deem appropriate. User’s continuance to use the Platform shall be deemed as User’s agreement to such amendments. It is an onus on the User to keep abreast of the changes and cannot justify breaching the amended terms and conditions by claiming ignorance of such amendments.
Responsibilities and Liabilities Exemptions of MedPark
- MedPark shall be responsible for expected damages caused by MedPark’s deliberate intention or gross negligence. However, MedPark shall not be responsible for any damages from extraordinary circumstances. User agrees that MedPark shall not be responsible for any damages caused by any event listed below:
  1. Access of the Platform by anyone using Identification Code of User.
  2. Any force majeure events or any events beyond MedPark’s control including malfunction of communication devices, network signal transmission, or interference by computer virus or other unlawful acts, or as the consequence of My MedPark platform shutdown for update or maintenance.
  3. Delay, error, or defectiveness of computer system; or any devices of User, or MedPark, or telecommunication network providers.
  4. Any delay experienced in the Platform.
  5. Any circumstance in which User does not comply with these or other related Terms and Conditions.
Severability
- In the event any part of these Terms and Conditions becomes void, illegal, invalid or unenforceable in any respect, the remaining provisions shall continue to be legal, valid and enforceable without being affected or impaired by the invalid parts.
Governing laws and Dispute Resolution
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. The courts of the Kingdom of Thailand shall have exclusive jurisdiction over disputes arising out of or in connection with Services and these Terms and Conditions.
